Terms of Service

These Terms form the agreement for using ListRush. Please read them before creating an account or buying a paid plan.

Effective:
10 September 2026
Version:
0.28.3

1. Operator and contact

ListRush is operated by Harry Simmons, trading as ListRush, as an individual sole trader. ListRush is a trading name, not a limited company or separate legal entity.

Business and service address:

2. Eligibility and accounts

You must be 18 or over to create or use a ListRush account and able to enter this agreement. You must confirm this at signup, give accurate account information, secure your credentials, and tell us promptly about unauthorised use. Provider and marketplace eligibility rules also apply.

Existing users are asked to confirm the same rule and accept this version. Users who decline can still access Settings to cancel a subscription, download their data or delete the account. If we reasonably learn that a user is under 18, we may restrict the account while arranging subscription cancellation, eBay revocation and appropriate deletion, retention or refund review.

3. The service

ListRush assists with AI listing creation and regeneration, photo enhancement, saved listings, preferences, templates, measurements, eBay connection and publication, Smart Postage, marketplace history, Relist / Refresh, Improve & Relist, subscriptions and AI allowances or add-ons. Features depend on the user’s effective plan. Complimentary access is free access that may have an end date; it is not a paid subscription.

4. Marketplace responsibilities

You remain the seller of your goods and responsible for your marketplace account and transactions. ListRush is not eBay or Vinted, does not become a party to a marketplace sale, and cannot override marketplace rules. The Vinted browser extension is unofficial automation, is not endorsed or authorised by Vinted, and may stop working or contribute to marketplace warnings or account enforcement if Vinted changes or restricts automation. It fills a visible draft only; you must review and publish it manually. Never use it to bypass a CAPTCHA or security challenge. Deleting or suspending ListRush access does not end live marketplace listings.

5. Listings and AI

AI text, suggested measurements, categories and enhanced images can be inaccurate or incomplete. Before publication, review the title, description, category, condition, measurements, price, photos, postage, item specifics and marketplace compliance. This responsibility does not remove rights you have where ListRush itself fails to provide the service with the standard required by law.

AI output is assistance, not professional, legal, tax or product-authentication advice. ListRush does not guarantee that output is accurate, complete, non-infringing or accepted by a marketplace.

6. Your content and intellectual property

You keep any rights you have in content you provide. You give ListRush a non-exclusive licence, only for providing, securing and supporting the service, to store, process, reproduce, transform, transmit and display that content; send relevant content to AI providers and eBay when requested; and make listing-photo addresses accessible where needed for the current marketplace architecture. The licence lasts while needed for those purposes, subject to disclosed backups, caches, provider records and justified marketplace history.

ListRush does not promise that copyright exists in AI output or that you own every right in it. You must have the necessary rights to upload and publish content. Provider terms and copyright/trademark questions may affect permitted use.

7. Acceptable use

Do not use ListRush for unlawful, counterfeit or stolen goods; fraud or misleading listings; intellectual-property infringement; malicious activity; unauthorised accounts or access; manipulating the service; bypassing plan or credit controls; abusing AI/provider infrastructure; or violating applicable marketplace rules.

8. Plans, subscriptions and credits

Free currently includes 10 listing generations and 2 photo enhancements per month. Casual is £6.99 per month plus applicable tax with 100 generations and 25 enhancements. Pro is £24.99 per month plus applicable tax with unlimited generations and 100 enhancements. Current pricing and feature screens form part of the description at purchase.

Paid plans recur monthly until cancelled. Stripe shows and collects the charge. Upgrades can take effect immediately with a prorated amount shown before confirmation; downgrades are scheduled for the end of the paid period. Portal cancellation schedules the subscription to end at the period end, after which effective access falls to Free unless valid complimentary access applies.

Included monthly allowances reset on the displayed date. Successful listing generation or photo enhancement consumes the applicable allowance; undo, redo, comparison, ordinary editing, saving and manual relisting do not. Purchased credits are used after included allowances. They do not expire while the account exists, survive subscription cancellation and downgrade, are non-transferable between accounts and cannot be redeemed for cash. Account deletion removes remaining balances. The identified AI routes charge only after a usable provider result, so a reliably failed operation does not consume a purchased credit.

9. Cancellation, cooling-off and refunds

You can stop future renewal through Manage subscription in ListRush, which opens Stripe’s Customer Portal. This prevents future renewal and paid access continues to the implemented billing-period end. Deleting the account instead attempts to cancel the active subscription immediately.

Consumers may have a 14-day statutory cancellation period for a new distance service contract. Before new paid-subscription checkout, you must separately and expressly request ListRush to start the paid service immediately. If you exercise an applicable right after service begins, ListRush may deduct or charge only an amount legally permitted for service already provided; the request does not waive all cancellation or refund rights.

The public cancellation and refund page explains how to contact us and provides a model form that is optional. Statutory cancellation, ordinary renewal cancellation, duplicate/incorrect charges, defective-service remedies and discretionary refunds remain distinct. Exact proportionate-payment calculations are manually reviewed pending professional approval.

10. Changes to features, prices and Terms

We may make proportionate changes for security, law, provider/API changes, service improvement, cost or commercial sustainability. We will not use this clause to remove mandatory rights. We will give reasonable advance notice of material detrimental changes where practicable, explain when they take effect, and provide an appropriate cancellation route. Price changes do not apply retrospectively to charges already paid. Trivial clarifications do not require renewed acceptance; material contractual changes may.

11. Availability

ListRush depends on Supabase, Stripe, OpenAI, Vercel and eBay and may occasionally be unavailable for maintenance, outages, API changes, security incidents or circumstances outside reasonable control. We do not promise uninterrupted or error-free service. This does not exclude responsibility where the law requires ListRush to put a problem right.

12. Suspension and termination

We may proportionately restrict or suspend access for a material breach, fraud, security risk, unlawful use, non-payment, abuse, or a provider/marketplace requirement. Where reasonably possible, we will explain the reason and allow a chance to remedy it. Immediate action may be necessary for security, fraud or unlawful activity. Permanent termination and its subscription, credit, data and refund consequences require a fair case-specific assessment.

13. Responsibility and statutory rights

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any responsibility or consumer remedy that cannot lawfully be limited. Consumers are entitled to services matching their description and provided with reasonable care and skill, and may have repeat-performance, price-reduction, refund or other remedies.

ListRush is not responsible for loss caused solely by a user’s unlawful content, failure to review a listing, or an independent marketplace decision where ListRush is not at fault. Any broader liability cap or business-user exclusion requires professional review and is deliberately not imposed in this version.

14. Law, complaints and communications

These Terms are governed by the law of England and Wales, but consumers retain mandatory protections and the right to bring proceedings available where they live. Contact admin@listrush.co.uk first so we can try to resolve a complaint. No contractual or statutory ADR scheme applying to ListRush has been identified; this must be rechecked before launch. The discontinued EU ODR platform is not used.

We may send operational account, billing, security and material-Terms notices using your account email. These are separate from optional marketing consent. The Privacy Policy explains information use and is not itself a contract acceptance or blanket consent.
